Terms of Service

Please read these Terms carefully before using Vivy. They govern your use of our app and services.

Important: Vivy is not a medical device and does not provide medical advice. Always consult a qualified healthcare provider before starting any health protocol.

1. Acceptance of terms

By downloading, installing, or using the Vivy mobile application or visiting the Vivy website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the service.

We may update these Terms from time to time. Continued use of the service after changes become effective constitutes your acceptance. Material changes will be communicated via in-app notification.

2. Description of service

Vivy is a health and longevity tracking platform that provides protocol management, compound research tools, biomarker logging, and AI-powered health intelligence. The service is intended for informational and self-tracking purposes only.

Not medical advice. Vivy does not provide medical advice, diagnosis, or treatment. Content on Vivy — including AI recommendations — is for informational purposes and should not substitute professional medical judgment. Always consult a qualified healthcare provider before starting, stopping, or modifying any health protocol.

3. Eligibility

You must be at least 18 years old to use Vivy. By using the service, you represent and warrant that you meet this requirement.

Vivy is available in jurisdictions where the app store and applicable laws permit. You are responsible for ensuring your use complies with local laws.

4. Account responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate information and keep your account information up to date.

You may not share your account, transfer it to another person, or use another person's account without permission.

Notify us immediately at support@heyvivy.com if you suspect unauthorized access to your account.

5. Acceptable use

You agree not to: (a) use the service for any unlawful purpose; (b) attempt to gain unauthorized access to any part of the service; (c) reverse engineer, decompile, or attempt to extract source code; (d) upload malicious code or interfere with service infrastructure; (e) scrape, crawl, or systematically extract data from the platform without express written permission; (f) impersonate any person or entity; (g) use the service to harm, harass, or defraud others.

6. Community content and moderation

Your posts. You are solely responsible for any content you post, comment, share, or submit to the Vivy community, including text, images, and links ("User Content").

License to Vivy. By posting User Content, you grant Vivy a worldwide, royalty-free, non-exclusive license to host, display, reproduce, and distribute that content within the Vivy service for the purpose of operating the community. You retain ownership.

Prohibited content. You agree not to post content that: (a) contains personalized medical advice for another user; (b) promotes the sale, trade, or sourcing of prescription drugs or controlled substances; (c) makes disease-cure or guaranteed-outcome claims; (d) targets or harasses another user; (e) infringes intellectual property; (f) includes CSAM, violent threats, or other content prohibited by law.

Moderation rights. Vivy may, at its sole discretion and with or without notice, remove, edit, or restrict visibility of any User Content that violates these Terms or our Community Guidelines, and may suspend or terminate accounts that repeatedly violate them. We use a combination of automated filtering and human review.

Appeals. If your content or account is removed and you believe the action was in error, you may appeal by emailing support@heyvivy.com within thirty (30) days of the action. Appeals are reviewed by a human moderator and you will receive a response within ten (10) business days.

7. Your content

You retain ownership of all health data, protocol configurations, and content you enter into Vivy ("Your Content").

By entering Your Content, you grant Vivy a limited, non-exclusive license to process and store it for the purpose of providing the service to you.

We do not use Your Content to train third-party AI models. Anonymized, aggregated signals may be used to improve Vivy's own AI recommendations, as described in our Privacy Policy.

8. AI companions and AI-assisted content

Acknowledgment. You acknowledge and agree that Vivy operates a set of branded accounts — collectively, the "Vivy Team" — that publish educational content and interact with users inside the Vivy community and on external social platforms. Some or all content from these accounts is generated or assisted by artificial intelligence and reviewed by Vivy staff prior to publication.

Transparency. Each Vivy Team account is identified on its profile page, and a directory of AI-assisted accounts is maintained at heyvivy.com/community/ai-companions. This disclosure is provided in compliance with California SB 1001, FTC Section 5 guidance on AI transparency, and equivalent obligations under other applicable laws.

No medical advice. Content from Vivy Team accounts — whether AI-assisted or human-written — is informational only, is not personalized medical advice, and does not create a patient-provider relationship. The disclaimers in Section 2 ("Description of service") and Section 9 ("Disclaimers and limitation of liability") apply in full to all AI-assisted output.

No impersonation. Vivy Team personas do not represent real individuals, do not claim clinical credentials they do not hold, and do not purport to have personal medical histories. Likeness of any real person is prohibited.

Your interactions. If you reply to or message a Vivy Team account, your message may be processed by automated systems to generate a response and by human reviewers for safety and quality. Message retention and PII handling are described in our Privacy Policy.

Your right not to engage. You are never required to follow, reply to, or otherwise engage with any Vivy Team account to use Vivy, and you may block or mute any such account at any time.

9. Intellectual property

The Vivy name, logo, app design, compound database, and all associated software are the intellectual property of Vivy, Inc. and are protected by applicable copyright, trademark, and other intellectual property laws.

Nothing in these Terms grants you a right to use Vivy's trademarks, logos, or brand assets without prior written consent.

10. Subscription and payments

Vivy may offer paid subscription tiers. Subscriptions are billed through the Apple App Store. All purchases are subject to Apple's terms and policies.

Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. Manage or cancel your subscription in your App Store account settings.

We do not issue refunds except as required by applicable law or App Store policy.

11. Disclaimers and limitation of liability

No warranties. The service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Health disclaimer. Vivy is not a medical device and makes no representations about clinical efficacy. Use of the service does not constitute a patient-provider relationship.

Limitation of liability. To the maximum extent permitted by law, Vivy, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service, even if advised of the possibility of such damages. Our total liability shall not exceed the greater of $100 or the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Vivy, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the service, violation of these Terms, or infringement of any third-party rights.

13. Termination

You may terminate your account at any time through the app or by contacting support@heyvivy.com.

We may suspend or terminate your access for violations of these Terms, with or without notice, at our sole discretion.

Upon termination, your right to use the service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.

14. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the service will be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property infringement.

You waive any right to participate in a class action lawsuit or class-wide arbitration.
